Özet
Bu eser, Osmanlı İmparatorluğu'ndan modern Türkiye'ye uzanan süreçte basın özgürlüğünün tarihsel gelişimini kapsamlı bir şekilde incelemektedir. İlk bölümde, basın özgürlüğünün demokrasi bağlamındaki kavramsal temelleri; ifade özgürlüğü, düşünce özgürlüğü ve basının demokratik toplumdaki rolü detaylı olarak analiz edilmektedir. Osmanlı döneminde basının gelişimi, Tanzimat reformları ve anayasal monarşi sürecindeki basın-politika ilişkileri ele alınmıştır. Abdülhamid döneminde uygulanan sansür ve baskılar ile II. Meşrutiyet dönemi basın özgürlüğü ve muhalefetin gelişimi derinlemesine tartışılmıştır. Türkiye Cumhuriyeti'nin kuruluşuyla birlikte basın yasalarının evrimi, 1864, 1909, 1931, 1950 ve 2004 yasalarının basın özgürlüğü üzerindeki etkileri analiz edilmiştir. 1961 ve 1982 anayasa dönemlerindeki basın özgürlüğü farkları incelenerek, özellikle 1982 Anayasası'nın basın özgürlüğüne yönelik kısıtlayıcı uygulamalarına dikkat çekilmiştir. Eser; basın özgürlüğünün demokratik bir toplum için elzem bir unsur olduğunu, ifade özgürlüğüyle sıkı sıkıya bağlantılı olduğunu ve tarihsel süreçte devlet politikaları, teknolojik gelişmeler ve toplumsal yapılar tarafından şekillendirildiğini ortaya koymaktadır. Ayrıca, çağdaş Türkiye'de basın özgürlüğü ile ilgili hukuki ve toplumsal tartışmalara ışık tutmaktadır.
This work provides a comprehensive examination of the historical development of press freedom from the Ottoman Empire to modern Turkey. The first chapter explores the conceptual foundations of press freedom within the context of democracy, detailing freedom of expression, freedom of thought, and the role of the press in a democratic society. The development of the press during the Ottoman era is discussed with focus on the Tanzimat reforms and relations between the press and politics during the constitutional monarchy. It deeply analyzes censorship and repression during the Abdülhamid period and the expansion of press freedom and opposition in the Second Constitutional Era. The evolution of press laws following the establishment of the Republic of Turkey is scrutinized, with analysis of key legislation of 1864, 1909, 1931, 1950, and 2004 and their impacts on press freedom. Differences in press freedom under the 1961 and 1982 constitutions are compared, highlighting especially restrictive practices under the 1982 Constitution. The work underscores that press freedom is an indispensable element of democratic society, closely linked with freedom of expression, and historically shaped by state policies, technological progress, and social structures. It also sheds light on contemporary legal and societal debates concerning press freedom in Turkey.
